These terms govern your use of getadacious.com (the “site”), operated by Adacious (“Adacious,” “we,” “us”). By using the site, you agree to these terms. If you do not agree, do not use the site. Use of the Adacious advertising platform and publisher SDK is also governed by the agreements we sign with customers and partners. If such an agreement conflicts with these terms, the agreement controls.

Eligibility

You must be at least 18 years old to use the site. If you use the site on behalf of a company, you represent that you have authority to accept these terms for it.

Use of the site

You may use the site to learn about Adacious and to contact us. If you are an Adacious customer, you may also use the site to access our services in accordance with your agreement with us, including to make your web properties available to receive advertising, or to place advertising directed to AI agents and the users they serve.

You agree not to misuse the site, including by attempting to gain unauthorized access to it, interfering with its operation, introducing malicious code, scraping it in a way that burdens our systems, or using it to violate any law or the rights of others.

Intellectual property

The site and its content, including text, graphics, logos, and the Adacious name, are owned by Adacious or its licensors and are protected by intellectual property laws. You may view and share links to the site, but you may not copy, modify, or distribute its content for commercial purposes without our written permission.

Information you send us

If you send us ideas, suggestions, or feedback, you agree that we may use them without obligation to you. Our privacy policy explains how we handle personal information.

Third-party links

The site may link to websites we do not control. We are not responsible for their content or practices.

No warranties

The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Content on the site is for general information only, and we do not guarantee that it is accurate, complete, or current, or that the site will be available without interruption or error.

Limitation of liability

To the fullest extent permitted by law, Adacious will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the site. Our total liability for any claim relating to the site is limited to one hundred US dollars.

Indemnity

You agree to indemnify and hold Adacious harmless from claims, losses, and expenses, including reasonable legal fees, arising from your misuse of the site or violation of these terms.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. You and Adacious agree that any dispute arising from or relating to these terms or the site will be brought exclusively in the state or federal courts located in the City of New York, New York, and you consent to the personal jurisdiction of those courts.

Changes to these terms

We may change these terms at any time, at our discretion. We announce changes by publishing the updated terms on this page and changing the effective date above. Changes take effect on that date, and continuing to use the site after that date means you accept them.

General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. Except as provided in any written agreement between you and Adacious, these terms, together with our privacy policy, constitute the entire agreement between you and Adacious regarding the site.
